Copywriter, Cover Thy Work Product! Talking About E&O Insurance

So you’ve written a slam-bang copywriting masterpiece. Client loves it, mails or publishes it. Then your client gets sued over something the copy did or did not contain. Or the client claims you didn’t deliver on stated promises of performance or some such.

Suddenly your happy-as-clam** client begins to eye you with a deeply litigious eye.

Now what?

You’re somewhat protected if you’re using a contract or letter of agreement that includes a strong indemnification clause in which the client promises to defend, hold you harmless, etc. for any work product they’ve formally approved and accepted.

Sometimes, though, that may not be enough. For the super-cautious among us, there’s Errors and Omissions and related professional liability insurance. (Sometimes the bigger clients may actually expect or even demand you have this coverage in place before they’ll work with you.)

Regular business insurance agents probably won’t be intimately familiar with this kind of coverage. So your Maven has done a little research and found this: E&O Insurance Explained.

When reviewing the various E&O types available, I didn’t see anything specific to copywriting. But at first glance, the Marketing Consulting Service seems like the best match. Spend some time reviewing the list. You may find a category that works better for you.

    One important note… if you do get E&O insurance, don’t let ANYONE know you have it. Telling anyone you have it is like writing a “Lawyer Bait” across your forehead.

    In any line of work these days you should always have some type of insurance to cover yourself and E&O insurance looks a good insurance to have.
